1. Scope And Updates To This Privacy Notice

This Privacy Notice (“Notice”) applies to personal information processed by us, including on our websites and other online or offline offerings. To make this Notice easier to read, our websites and other offerings are collectively referred to as the “Services.” 

This Notice does not apply to any of the personal information that we process on behalf of our customers (i.e., distributors and retailers) through their use of our Services (“Customer Data”). Our customers’ respective privacy policies govern their collection and use of Customer Data. Our processing of Customer Data is governed by the contracts that we have in place with our customers, not this Privacy Notice. Any questions or requests relating to Customer Data should be directed to our customer.

Changes to our Privacy Notice. We may revise this Privacy Notice from time to time in our sole discretion. If there are any material changes to this Privacy Notice, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Notice if you continue to use our Services after the new Privacy Notice takes effect.

2. Personal Information We Collect

The categories of personal information we collect depend on how you interact with us, our Services, and the requirements of applicable law. We may collect information that you provide to us, information we obtain automatically when you use our Services, and information from other sources such as third-party services and organizations, as described below.

A.　Personal Information You Provide to Us Directly

We collect personal information that you provide us as follows.

• Account Creation. We may collect personal information when you create an account, such as name, contact information, email address, telephone number, username, password.
• Purchases. We use third-party payment processors to collect personal information and details associated with your purchases, including payment information. Any payments made via our Services are processed by third-party payment processors. We do not directly collect or store any payment card information entered through our Services, but we may receive limited information associated with your payment (e.g.,  date of payment, transaction amount, and method of payment) for the purposes of record-keeping, purchase confirmation, and purchase verification.
• Your Communications with Us. We may collect personal information, such as email address, phone number, or mailing address when you request information about our Services, register for our newsletter or loyalty program, request customer or technical support, or otherwise communicate with us.
• Surveys. Subject to your consent where required by applicable law, we may contact you to participate in surveys. If you decide to participate, we may collect personal information from you in connection with the survey.
• Interactive Features. We may collect personal information that you submit or make available through our interactive features (e.g., messaging and chat features, commenting functionalities, blogs, and social media pages). Any information you provide using the public sharing features of the Services will be made available to the public and may be re-used and disclosed by any viewer, recipient or other third party for any purpose. We are not able to control the use or disclosure of your personal information by such third parties. Please exercise caution before revealing any information that may identify you in the real world to other users.
• Sweepstakes or Contests. Subject to your consent where required by applicable law, we may collect personal information you provide for any sweepstakes or contests that we offer. In some jurisdictions, we are required to publicly share information of sweepstakes and contest winners.
• Business Development and Strategic Partnerships. We may collect personal information such as name, phone number, nature of business, email address, and business address from suppliers, partners and similar third parties to assess and pursue potential business opportunities.

Ｂ.　Personal Information Collected Automatically

We collect certain information automatically when you use our Services as follows.

• Log and Activity Information. We may collect certain information automatically relating to your use or access to our Services, such as your Internet protocol (IP) address and associated location information (including approximate location derived from IP address), operating system, MAC address, cookie identifiers, mobile carrier, and other unique identifiers, browser or device information, and Internet service provider. We may also automatically collect information regarding your use and access to our Services, such as pages that you visit before, during and after using our Services, information about the links you click, the types of content you interact with, the frequency and duration of your activities, and other information about how you use our Services.
• Cookies (and Other Technologies). We may use first party or third party cookies and pixel tags ("Technologies") to automatically collect information through your use of our Services.
  • Cookies. Cookies are small text files placed in device browsers that store preferences and facilitate and enhance your experience.
  • Pixel Tags. A pixel tag is a piece of code embedded in our Services that collects information about engagement on our Services. The use of a pixel tag allows us to record, for example, that a user has visited a particular web page or clicked on a particular advertisement. We may also include web beacons in e-mails to understand whether messages have been opened, acted on, or forwarded.
• Social Media Platforms. Our Services may contain social media buttons, such as Meta, YouTube, X (formerly Twitter), Pinterest, and Instagram which might include widgets such as the "share this" button (“Plugins”). These Plugins may collect personal information such as your IP address and which page you are visiting on our Services and may set a cookie to enable the feature to function properly. Your interactions with these platforms are governed by the privacy policies of the social media organization providing the relevant Plugins.

A.　Provide Our Services

We may use your information to fulfil our contractual rights and duties with you and provide you with our Services, such as:

Some of the ways we market to you include email campaigns, text messages, custom audiences advertising, and "interest-based" or "personalized advertising," including through cross-device tracking.

A.　Disclosures to Provide our Services

The categories of third parties with whom we may share your personal information are described below.

• Service Providers. We may share your personal information with our third-party service providers and vendors that assist us with the provision of our Services. This includes service providers and vendors that provide us with IT support, hosting, payment processing, customer service, and order fulfillment. More specifically, we may share:
  • Payment information with payment processors who may use such information for the purposes of processing payment on our behalf.
  • Name, email, address and phone number with consumer support and service providers offering Interactive Features (described in Section A) such as messaging and chat and commenting features, or social media Plugins.
  • Order fulfillment information with distribution and warehousing providers. 
• Affiliates. We may share your personal information with our affiliates, subsidiaries, and other entities within our group, to the extent required for them to provide us with  administrative, IT management, and operational related services to  support and supplement the Services we provide.
• APIs/XMLs. We may use third-party application program interfaces ("APIs") and  extensible markup language ("XMLs") as part of the functionality of our Services. We may share your personal information with the providers of these APIs and XMLs to the extent necessary for us to maintain and support the functionality of the Services.

We may disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our, or others' rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity, all as required or permitted by applicable law.

C.　Disclosure in the Event of Merger, Sale, or Other Asset Transfers

Your Privacy Choices. The privacy choices you may have about your personal information are determined by applicable law and are described below.

• Email Communications. To opt out of receiving marketing and promotional email communications from us, you can use the unsubscribe link found at the bottom of our email to opt out of receiving future emails or by otherwise contacting us as set forth in "Contact Us" below. Note that you will continue to receive transaction-related emails regarding products or Services you have requested. We may also send you certain non-promotional communications regarding us and our Services, and you will not be able to opt out of those communications (e.g., communications regarding our Services or updates to our Terms or this Privacy Notice).
• Text Messages. To opt out of receiving text message from us, you may following the instructions in the text message you have received from us or by otherwise contacting us as set forth in "Contact Us" below.
• Cookies and Personalized Advertising. You may stop or restrict the placement of cookies and other technologies on your device or remove them via our Cookie Settings page or through our cookie banner displayed to you when you visit our website. However, if you limit the use of cookies or withdraw your consent, we may no longer be able to provide you with our Services or certain Service features and functionalities may not work properly. Your Privacy Rights. In accordance with applicable law, you may have the right to:

• Access Personal Information about you, including: (i) confirming whether we are processing your personal information; (ii) obtaining access to or a copy of your personal information;
• Request Correction of your personal information where it is inaccurate, incomplete, or outdated. In some cases, we may provide self-service tools that enable you to update your personal information;
• Request Deletion of your personal information that we have collected about you. In some cases, we may be unable to delete your personal information where we have, or an organization to which we have disclosed your personal information has, a statutory obligation to retain such information;
• Withdraw your Consent to our processing of your personal information. Please note that your withdrawal will only take effect for future processing and will not affect the lawfulness of processing before the withdrawal. If you refrain from providing personal information or withdraw your consent to processing, some features of our Services may not be available;
• Request a portable copy of personal information that you have provided to us;
• Be informed about third parties with which your personal information has been shared; and
• Right to submit your observations and request the review of decisions based exclusively on automated processing of your personal information  (applicable in Quebec only).

Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized access, use, disclosure, or loss of personal information.

By using our Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Services. As permitted by applicable law, we may attempt to notify you electronically by posting a notice on our Services, by mail, or by sending an email to you.

7. Retention Of Personal Information

We store the personal information we collect for as long as necessary to carry out the purposes described in this Privacy Notice, unless longer retention is permitted or mandated by applicable law.

8. Roles and Responsibilities

We have established and implemented privacy governance policies and practices regarding the protection of personal information. In particular, such policies and practices provide a framework for the storage and destruction of personal information, define the roles and responsibilities of the members of our personnel throughout the life cycle of personal information that we collect and process, and provide a process for dealing with complaints regarding the protection of personal information.

9. Children's Information

The Services are not intended for minors under 18 (or other age as required by local law), and we do not knowingly collect personal information from minors.
If you are a parent or guardian and believe your child has provided personal information to us without your consent, or wish to review information collected from your child, or have that information modified or deleted, you may contact us as described in "Contact Us" below. If we become aware that a minor has provided us with personal information in violation of applicable law and of this Privacy Notice, we will delete any personal information we have collected, unless we have a legal obligation to keep it, and terminate the minor's account if applicable.

10. Data Location and Data Transfers

Your personal information may be transferred to, and processed in, countries outside of Canada. If you live in Quebec, your personal information may be communicated to entities outside of Quebec. We, our affiliates and our third-party service providers may operate around the world. This means that when we collect your personal information, such information may be processed in any of these countries, and accordingly, may be accessible to courts, law enforcement and national security authorities of those countries.

Third-Party Websites/Applications. The Services may contain links to other websites/applications and other websites/applications may reference or link to our Services. These third-party services are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen, or approve, and are not responsible for, the privacy practices or content of such other websites or applications. Providing personal information to third-party websites or applications is at your own risk.
